国際刑事裁判所制度が高度に発達した現在の視点から、東京裁判の意義をとらえなおすために、平成23年度には、以下の点を中心として研究を進めてきた。第一に、東京裁判で取り上げられた歴史的事実についての検証を行った。満州事変やノモンハン事件をはじめ、日本の侵略行為に関する歴史学上の研究の新しい成果を取り入れつつ、東京裁判の事実認定についての再評価をこころみた。第二に、東京裁判・ニュルンベルク裁判を出発点とし、のちに国際刑事裁判所における実務的発展につながってゆく国際刑事法の理論的研究を行った。連合国による「戦犯」裁判における法理論が、普遍性を志向する国際刑事裁判所に受け継がれる理論的・実践的過程にとくに着目している。このため、国際人道法・国際刑事法に関わる歴史的・理論的資料を多く収集した。第三に、東京大学や広島大学で行われた研究会において、内外の国際法学者・刑法学者・歴史学者との意見交換を行い、東京裁判研究の現段階を多角的な視点から再確認した。とくに、歴史的諸資料を用いた歴史学上の実証研究を通じて得られた東京裁判の評価や、国際刑事法の実務を念頭においた刑法学の観点からの東京裁判の意義について、有益な見解が得られた。第四に、国際刑事法の発展と表裏の関係にある国際人道法の発展について、とくに核兵器使用の違法性の問題に焦点を当てつつ、研究を行った。その際、これまでに公表してきた研究業績を再検討し、著作として公表した。
