General surveys on sources of law in Contemporary French Law

本文主要探讨新判例规则溯及效力的限制问题，这是当代法国法中最重要的法源问题之一。最高法院承认有可能作出可能的推翻。但是，传统的判例法概念对这一立场提出了反对意见，判例法必须仅仅是对立法法的解释，是唯一的法律渊源。

This survey concerns mainly the problem of limitation of retroactive effect of a new case rule, which is one of the most important problems on sources of law in contemporary Frech Law. The Cour de cassation admitted exceptional possibilities of prospective overruling. But objections subsit against this position from the traditional conception of case law which must remain only interpretations of legislative law, unique source of law.
