项目摘要

1.19～20世紀の日本、ドイツ及び諸外国における著作物の性質に関する諸学説の検討本年度においては、著作者人格権の客体である「著作物」につき、作品における個性の顕現=「独創性(現行著作権法においては『創作性』)」が著作権法において保護されるべき著作物の要件として通説で、この個性の顕現を契機として著作者人格権が基礎付けられており、著作者人格権を考察する上で当該「独創性」概念の形成過程を追うことは非常に重要であると考えられるため検討を行った。2.19～20世紀日本における著作権法制定過程及び判例学説に関する検討本年度は、諸外国において徐々に確立した著作権及び著作者人格権に関する諸理論を明治～昭和期の日本がいかに吸収して日本旧著作権法に反映したのか、という点につき、特に旧著作権法制定当初におけるフランス著作権法の影響、そしてベルヌ条約との関係も考慮しつつ検討を重ねた。3.19世紀～20世紀初頭ドイツにおける著作者人格権学説史に関する検討本年度においては、著作者人格権の理論的基礎が形成される過程につき、1.との関連を踏まえつつ検討を行った。とりわけ著作者の保護を重視する法体系となった直接の原因として、1.における「独創性」概念が大きな役割を果たしたと考えられることから、美学における「独創性」概念との関連や、19世紀を通じて徐々に高まっていく「天才」作者への畏敬という点について検討を行った。また前年度から継続して、この点につき作品の享受者たる市民や作者と市民を仲介する出版社との関係についても検討した。4.著作権法における「仲介者(ゲートキーパー)」の検討出版社等の著作権法における「仲介者(ゲートキーパー)」の役割につき、現代における仲介者と19世紀における仲介者の役割・立場の相違を考察するにあたって、現行著作権法における「間接侵害」の事例を中心に検討を行った。
