A study was conducted in Japan and France to investigate the legal protections, in terms of protection of a right to family formation and the right of life, of diversified families whose concept differs from that of the traditional family.In France, discriminatory inheritance by illegitimate children was abolished and protection of the right of adoption of children by homosexual individuals was achieved as a result of the right to respect for private and family life under Article 8 of the European Convention on Human Rights. In Japan, too, the Supreme Court decision concerning discriminatory inheritance by illegitimate children of September 4, 2013 suggests that the effects of foreign laws and international conventions on human rights are positioned to change the the supports legislative facts.The study revealed that external safeguards based on human rights conventions can potentially change the traditional view of the family, which is based on the domestic democratic majority.

日本和法国进行了一项研究，调查与传统家庭概念不同的多元化家庭在家庭形成权和生命权方面的法律保护。在法国，由于《欧洲人权公约》第八条规定的尊重私人和家庭生活的权利，废除了对非婚生子女的歧视性继承权，实现了对同性恋者收养儿童权利的保护。在日本，最高法院2013年9月4日关于非婚生子女歧视性继承问题的裁决表明，外国法律和国际人权公约的影响可能会改变支持的立法事实。研究表明，基于人权公约的外部保障措施可能会改变以国内民主多数为基础的传统家庭观。
