项目摘要

今年度は、フランス憲法院の判断手法および例外的に実施される「事後審査」の特徴を明らかにするとともに((1)「憲法院の審査機能と判断手法--解説」)、ニューカレドニアの緊急事態に関する1985年11月25日判決((2)「審署後の法律に対する『事後審査』)、および地方直接税に関する1968年1月30日判決((3)「解釈留保--地方直接税判決」)をてがかりにして、憲法院判決が裁判機関や政治部門に及ぼす影響について検討を試みた。さらに、フランス憲法院に関する邦語・仏語文献のデータベース作成の一環として、(4)「フランス憲法院関係・仏文文献目録」(5)「フランス憲法院=憲法判例関係・邦文文献目録」を公表した((1)〜(5)=いずれも、フランス憲法判例研究会編『フランスの憲法判例』所収)。また、裁判機関に対する影響のみならず、フランス本土あるいは海外領の立法・行政に対する憲法規範・憲法判例の影響に関しても、引き続き検討を試みた。現地における調査・研究をふまえ、フランス海外領の立法・行政機関に対する憲法判例・憲法規範の影響、およびその射程について分析し、(6)「ニューカレドニアにおける最近の自治権拡大に関する覚書--コングレとニューカレドニア政府の権限を中心に」(明治学院大学法律科学研究所年報18号)および(7)「ニューカレドニアにおける自治権拡大とフランス憲法院」(明治学院論叢法学研究74号)を公表することができた。これによって、とりわけ1998年のヌメア協定、1999年の組織法律で、一定程度の立法権が地方議会に認められたと同時に、フランス憲法院の判例や憲法規範が、より直接的に地方議会の立法や地方行政に影響を及ぼしうることとなったことが明らかにされた。

This year, the Constitutional Court's judgment method and exceptional implementation are explained in the characteristics of the "post-event review"((1)"Review function and judgment method of the Constitutional Court-explanation"), the judgment of the Constitutional Court on the emergency situation of November 25, 1985 ((2)"Post-event review of the law after the review"), and the judgment of the Constitutional Court. The judgment of January 30, 1968 concerning local direct taxation ((3)"Detentions and Protection-Local Direct Taxation Judgment") is discussed in detail, and the judgment of the Constitutional Court has an impact on the judicial organs and political departments.
