本年度の研究の内容は、概ね交付申請書における研究目的の欄に掲げたものに沿っており、その点で変更はない。すなわち、グローバル化の進展に伴う「民主主義の赤字」への対応として、国内議会が果たすべき機能の解明である。本年度の研究の成果という面では、博士学位論文「グローバル化時代の議会民主政--ドイツ・アメリカの議論を手がかりにして--」を完成させ、京都大学より博士(法学)の学位が平成24年3月26日に授与されたということを、なによりもまず挙げておかねばならない。当該論文において、私は、まず議会による条約承認手続に焦点を当てて、我が国における従来の議論、ドイツ連邦共和国における議論、アメリカ合衆国における議論を参照し、それを紹介した。その中で、条約承認手続の要求される、「条約」への該当を形式的な基準のみによるのではなく、実質的な観点から判断することの必要性を指摘するとともに、「条約」以外への類推適用による「拡張」の可能性についても言及した。また、アメリカにおける国際合意の締結の在り方が従来我が国で紹介されてきたものとは異なっているという点についても解明した。次に、私は「条約」承認には限られない、国内議会による対外事項への、より広く積極的な関与の可能性についても指摘した上で、議会の限界にも言及し、行政立法手続に関するものを主に念頭に置きつつ、行政手続の利用が国際的に形成される規範の民主的正統性の確保に当たり一定の役割を果たすことについても解明した。以上の検討は、当初の予定よりも、より深く掘り下げて行われたため、研究計画において挙げた、裁判所の役割の解明については、裁判所にも民主的正統性確保にあたって寄与する可能性があることを指摘できるにとどまってしまった。また、これに伴い、博士学位論文の全部ないし一部を本年度中に公表するに至ることができなかった上、書籍等の資料の拡充に研究費の大半が投入されることとなった。
