项目摘要

今年度は植民地時期の台湾における妾制度に注目し、日本民法の適用に伴い、台湾における家、婚姻に関する法制及び社会通念の改変を検討することを通して、台湾における妾制度にかかわった政治的及び社会的状況についての考察・分析を行ってきた。現在、台湾における妾制度についての研究はある程度蓄積が見られるものの、主に清朝統治下の台湾における妾に関する研究や蓄妾という風習を概観したものが多く、日本植民地法制下の台湾の妾制度について論究するものは管見の限りまだ見当たらない。そのような研究の現状を前提として、まずは日本民法の適用前と適用後において、台湾において妾というものに関わる権利や義務の変動を整理することに専念した。考察の結果、日本法制の移行が台湾の妾制度にもたらした影響は主に以下の二点であると思われる。一点目は、妾は法律上の人格が認めされ、夫に対して離縁請求を出す権利を獲得したことである。二点目は戸籍登録の変更により、妾を「妻」に昇格させることが一般的に行われ、妾と妻の間に横たわった境界線がなくなったことである。次に、主に1920-40年代の『壷湾日日新報』の新聞記事を取り上げ、廃妾(蓄妾)論議の整理と分析作業に着手し、当時の台湾の妾を囲んだ社会的状況を捉えることを試みた。分析の結果、かなり多岐にわたった妾像に辿りついた。日本民法が台湾で適用されていく前になされた廃妾論議における顔もない妾像に、後に法律上のグレーゾンを生み出し、それに日本帝国の境界線を脅かす妾像に、また無智で金銭と財物を目当てにするモグリの売春婦のような妾像に、「自由恋愛」を敢行した新女性の妾像はそうである。そういった一枚岩でない妾像は、台湾の妾制度にかかわった政治的及び社会的状況はいかに錯綜したかを物語っていると考えられ、引き続き深究に値する重要な研究課題である。
