项目摘要

最終年度では、「感情立法の形成に関わる一般的な法情報の構造を解明する」を中心課題にして理論かつ実証的な検討を展開し、「感情」的言説が現在日本の刑事法立法過程に一定の影響力を持つようになった背後には、内容的に異なった役割を担う法情報が分化しないまま法情報の伝達効果が増加した結果、メディア間ないし発言者間に「感情」―「法律学」という対立軸が形成され、法律専門家の言説が相対化される立法動向を起こしかねなくなっていること、が指摘できる。理論面では、法律家の役割変容を析出するため、日本における法知識、法情報と法意識、三つの概念の変容と連動を検討した。その結果、一般人に向ける知的啓蒙という意味を含め法専門家の社会発信が広く行われてきた上で法知識と法意識との区別が曖昧になること、発信者としての日本の法学者自身が社会の一般約な言説の間の鋭い緊張関係を自覚的に対応した上で法情報の内実が変動的であること、を明らかにした、本研究の検討は、いままでの法言説に開する分析に見られなかった日本の法学・法律家の応答的かつ流動的な姿勢を示しつつ、現代社会で法学専門の細分化と共に法情報と社会の一般情報との齪䶜を原理的にはらむことも指摘できた。実証面では、戦後の刑事訴訟法改正の立法動向と新聞と法律雑誌の報道体制を相互参照しながら、その中に見られる法律観を検討した。具体的に、1)1954～2012年における刑事訴訟法改正に関する朝日新聞の記事を対象に、記事分布、文体構成、評価立場などの側面から刑事訴訟法改正にかかわる報道の変化を分析した。その結果、政治の動向から日常の治安へと主題が変化しており、なかでも非専門家の情報源が重視されるようになってきたことが新聞では明らかになった。2)昨年の『法律時報』分析の延長線上で1950～70年代における刑事法改正(案)をめぐる特集記事の分析から、刑事法改正問題を積極的に取り扱った時期とは専門家としての批判的姿勢を鮮明にするだけでなく、専門家のネットワークをベースにした論説等によって法改正の動きに影響を及ぼそうと意識されたこと、が実証された。
