项目摘要

本研究は、後期ローマ・ビザンツ帝国社会における宦官・去勢者の位置づけが、4-10世紀にかけていかに変化したのかを考察するものである。中でも帝国の転換期である7世紀という時代、さらに従来の宦官研究において軽視されてきた法史料に注目することで、古代から中世に至る政治・ローマ法・社会の変化の諸相の一端を明らかにすることを目的とする。そのため、6世紀の皇帝ユスティニアヌス1世により編纂された「ローマ法大全」の後に編纂された8世紀の『エクロゲー法典』、9、10世紀の『バシリカ』等における去勢者・生殖不能者に関する規定とその背景について検討することが本年度の目標であった。本年度の研究成果は以下の通りである。第一に、『エクロゲー法典』以降新たに導入された身体切断刑、特に陰茎切除の規定について分析した。そして、陰茎切除は私刑としてローマ喜劇のなかで度々言及されるものの、成文法として同法典に導入された背景には、キリスト教の影響を受けた皇帝のイデオロギーが存在している可能性を指摘した。これと関連して、7世紀以降の叙述史料に頻繁に反乱により廃位された皇帝やその家族に対する身体切断・去勢についても検討し、現実の皇帝廃位という事件と法における切断刑導入との間の関係性について考察を加えた。最終的な結論には至っていないが、前者が後者に影響を及ぼした可能性は高いと考えられるため、引き続き調査を行う予定である。加えて、今後はビザンツ法におけるその他の規定や教会法の影響にも注目しながら去勢に対する支配者や法学者たちの眼差しの変化やその背景にある帝国社会の変化について明らかにする必要がある。最終的に本研究は、宦官の政治権力が最高潮に達したといわれる10世紀までの去勢者の法的・政治的・宗教的地位を総合的に分析することで、ローマとビザンツを区別する特徴の一つとされた去勢者の歴史的展開を明らかにする予定である。
