今年度は、まず、前年度に引き続き、公正な裁判を受ける権利についての研究を行った。その結果、量刑の領域について欧州人権裁判所における公正な裁判を受ける権利を参考にするには、もうしばらく裁判例の集積を待つ必要があることが明らかとなった。そのため、当初の計画を変更し、以降は次のように研究を進めた。すなわち、本研究課題を遂行する上では、まずもって「問題解決型司法」という概念が、どのように発展してきたのかを明らかにすることが有益であると考えられることから、本年度はこれに取り組んだ。特に、わが国における問題解決型司法の歴史的展開については、すでに一定程度明らかとなっている一方（拙稿（2016）「問題解決型刑事司法の課題と展望：歴史的・訴訟法的観点からの一考察（１）」九大法学113号63-122頁参照）、現在、問題解決型裁判所において問題解決型司法が実践されているアメリカにおける問題解決型司法の展開過程を明らかにすることは、本研究課題のみならず、わが国の問題解決型司法の今後にとっても重要な論点であるにもかかわらず、かかる観点からの分析は、国内外を問わず、これまで皆無であった。そこで、本年度は、植民地時代から現在まで、アメリカの刑事司法領域において、問題解決型司法という考え方が、どのように実践・展開されてきたのかを分析した。その結果を、刑事司法領域における問題解決型思考の展開と現代的課題：アメリカにおける歴史的展開を題材として」としてまとめ、学位請求論文として提出し、博士（法学）の学位を取得した。
