本研究では、アメリカにおける憲法学及び動物法学での法理論に関する文献及び訴訟実践にかかる判決資料を用いて、①「人権保障ベースの憲法理論のもとで成り立つ既存の社会にとって、法による動物保護とはいったい何なのか」、②「法による動物保護は、いかに既存の憲法判例理論に影響を与え、どのように実現し得るか」を明らかにしようとする。2022年度には、まずこの後者②にかかる研究として、アメリカにおける信教の自由を理由とした解剖実習受講拒否に関する事例の検討を行った。動物保護の推進と信教の自由保障のあいだには緊張関係があるとされてきたが、ここでは動物保護を推進する側が信教の自由保障の枠組みを用いた主張を行っていることに着目し、両者を調和的に理解する方途を探った。研究成果は2022年6月11日に行われた第83回宗教法学会にて報告した（2024年度刊行の学会誌にて発表予定）。また、①及び②にかかる研究として、2022年にニューヨークで下された判決（Nonhuman Rights Project, Inc. v, Breheny）の検討を行った。本判決は、アメリカの動物法学者であるSteven M. Wiseの設立したNonhuman Rights Projectという団体が動物園のゾウのための人身保護請求を行ったものである。Wiseは、動物倫理学において議論される「動物の権利」論を、法理論として、実際に訴訟の場で主張できる形で取り入れようと、研究及び実践を行っており、本判決を検討することで、ニューヨーク州の裁判所がこれをどのように受け止めたかを明らかにすることができる。判決の検討の成果は、2023年3月に論文として発表した。さらに、2022年度末には、研究のアウトリーチ活動の一環として、沖縄法政研究所の第83回研究会にて「アメリカにおける動物裁判の展開と類型」と題した研究報告を行った。
