项目摘要

初年度である2022年度は、アメリカやカナダにおける「司法積極的グローバリズム」の意義についての検討を行った。特に、両国における受動的対応（憲法解釈方法や条約の国内的効力）だけではなく、能動的対応（司法の国際交流機能や裁判管轄権）に着目した調査と分析を行った。まず6月に中京大学に参集して、オンラインではあるが、国際学会（The International Society of Public Law Conference (ICON-S)）に参加した。そしてその折に、研究者間で問題状況や課題等に関する情報の共有を行うとともに、新たな課題の確認等を行った。また9月にはSeton Hall Law Schoolの憲法研究者を訪問して交流することで、さまざまな知見を得るとともに、研究者間で情報の共有を行い、問題状況の整理を行った。これらの調査と文献調査を踏まえて、両国においては受動的対応だけではなく、さまざま能動的対応が行われていることを確認した。特にカナダでは、最高裁判所がイギリス、アメリカ、フランス、オーストラリア、ニュージーランド、ドイツ、インド、イスラエルの最高裁判所などと、定期的に少なくとも何らかの交流を行っていること、それだけでなく、裁判官が個別に各国の裁判官と積極的に交流を行っていることを確認した。両国における「司法外交」はこれだけに限られないが、こうした司法積極的グローバル化が新たな法的アイディアを創出していることが明らかになった。以上のように、本年度は司法積極的グローバリズムの状況整理を行い、次年度以降の研究につなげる基盤を形成した。
