本年度は、研究テーマについての研究を進めるとともに、以下の研究成果公表の機会を得た。第一に、サプライチェーンにおける特許権侵害の問題をテーマとするシンポジウムを、2022年度工業所有権法学会の研究大会で企画・実施し、そこで総論及び複数主体が関与する侵害についての報告を行った。これは、必ずしも越境的な事例を想定した検討ではないが、その検討の基礎となる課題についての分析であり、本研究にも非常に有意義であった。なお、報告内容については、同学会年報に論文を掲載予定である（2023年6月刊行予定）。第二に、研究テーマに直接かかわる事例に関する裁判例について、詳しい検討を行い、その成果を研究会で報告するとともに、論文として公表した。具体的には、一つは、L-グルタミン酸製造方法事件に係る東京地裁判決（東京地判令和2.9.24平28（ワ）25436号）である。これは、越境的取引に係る譲渡の申出、外国で生じた損害についての損害賠償算定等、本研究の対象とする論点を正面から取り上げている。もう一つは、ドワンゴ対FC2事件に係る東京地裁判決（東京地判令和4.3.24令元（ワ）25152号）及び知財高裁判決（知財高判令和4.7.20平30（ネ）10077号）である。この事件は、ネット配信される動画にコメントを同時に表示するサービスに係る物の発明と方法の発明に係る特許との関係で、サーバーが外国に所在する被告らのシステムが問題となった事例である。本事件では、特許制度に係る属地主義の意義が問われており、本研究にとっても、基礎的な論点について検討するうえで好適な検討対象となった。第三に、国際的な研究活動として、EUの特許制度の動向に関する国際シンポジウムを開催し、欧州の専門家との意見交換を行ったほか、東南アジア等の研究者との意見交換も実施した。

This year, the following research results are presented as opportunities for further research. First, the report on the problem of infringement of the license shall be submitted to the 2022 Annual Research Conference of the Industrial Property Law Society for planning, implementation and summary. This study is of great significance to the analysis of the basic problems of cross-border cases. This event is related to the distribution of information, animation, simultaneous presentation of information, system of information, method of information, licensing, relationship, system of information, defendant's system of information, etc. This article discusses the significance of territorialism in the franchise system, and the basic arguments of this study. Third, international research activities, trends in the EU licensing system, the opening of the international community, the exchange of views between European countries, and the exchange of views between Southeast Asian researchers.
