1、1993年の化学兵器禁止条約は、条約の実効性を高めるため、民生用の化学産業施設に対しても広範な検証措置を実施するにもかかわらず、その秘密扱いに関する付属書では、化学兵器禁止機関は機関の職員(査察員を含む)による秘密情報保護義務の違反に対して損害賠償責任を負わない旨が明記されている。その背景には、機関が責任を負うとすると、最終的には機関の構成国である各条約加盟国に負担がかかってくることから、条約交渉過程で諸国が機関の無責任を希望したという事実がある。2、一般国際法上、国際機関とその職員たる査察員に対して秘密漏洩を含む不法行為責任を負わせることは可能であろうか。この点に関しては、違法行為には責任が伴うという法原則は国際機関の行為についても妥当することが、学説上一般に支持されている。また、種々の国際機関特権免除協定において、機関自身の特権免除と機関の職員の特権免除のいずれに関しても、免除の放棄の可能性が規定されていることからすれば、機関の職員の双方について、損害賠償を含む民事責任追及の「可能性」が認められているということになろう。3、免除の放棄に関しては、一般に、機関の職員の免除については、一定の場合に事務局長に免除を放棄する「権利と義務」があるとされるのに対して、機関自身の免除の場合には、機関の裁量とされている。職員の賠償支払能力が限られていることを考えると、機関自身の免除放棄の可能性が極めて限定されているとの印象は否めない。立法論としては、免除放棄の可否に関して独立の第三者の意見を求めるなどの方策が考えられよう。ただ、いずれにしても、機関による賠償支払は最終的には各加盟国の負担となる以上、とくに多額の賠償支払の可能性がある場合には、機関による民間保険への加入が不可欠となろう。
