项目摘要

本研究は、大量破壊兵器とその運搬手段および軍民両用技術（汎用品）にかかる輸出管理制度の拡張傾向とその限界を、国際法学、国際関係論、経済学の複合的な視点から分析し、その成果をWTO訴訟案件や輸出管理政策の実務提言に結び付けることを目的とする。本年度は、研究の初年度ということで、研究代表者、研究分担者、研究協力者の間で問題意識、基本的概念、基本的アプローチ、現状認識を共有することに主眼を置いた。まず、５月にオンラインで国内の研究会を開催し、核兵器拡散との関係で現在最も注目されているイランによる核開発の問題を素材に、大量破壊兵器とその運搬手段の拡散防止について問題意識の共有を図った。浅田正彦研究代表者が「イラン核合意の法的側面」と題して、「イラン核合意（JCPOA）」の法的性格、その背景、内容面で特に注目されるスナップバック・メカニズムを中心に報告を行い、鈴木一人研究分担者が「イラン問題の政治的側面」と題して、イラン核合意に至る歴史的な経緯を1950年代まで遡って検討すると共に、オバマ政権によるイランとの合意達成、トランプ政権による合意からの離脱の背景について報告を行い、両報告に対して活発な質疑が行われた。９月には第２回の国内オンライン研究会を開催し、外務省の谷内一智国際法局経済紛争処理課長をお招きして、「最近のWTO紛争処理の状況―安保例外に焦点を当てて―」と題した報告をいただいた。WTOをめぐる最近の情勢について統計を含めて概説すると共に、最近の具体的なケースを取り上げて、その政治的性格の強さの指摘があった。最後に、我々の研究とも直結する日韓の輸出管理事案について、その経緯、関連事実、最近の動向などについて詳細な説明がなされ、その後に活発な議論が行われた。こうした研究会の開催とその概要については、本研究の対外発信のために新たに開設したホームページにも掲載した。
