项目摘要

2022年度前半においては、中世以降に作成された後期作品群に見られる〈相続人としての息子の種類分け〉を網羅的に扱うことに注力した。その成果は学会（2回）、学術雑誌（2回）などで発表した。報告者の調査によって、先行研究では十分に検討されてこなかった、i) 息子についての議論と結婚・相続との関わり、ii) 最も重要な息子である「嫡出子」の位置づけの変遷、などの一端を明らかにすることができた。後半においては、ガウディーヤ学派において最も新しい作品の一つ「法律的紛争の海（に架かる）橋」Vivadarnavasetuにおける相続法を主に検討した。同書からは、本研究にとって示唆的な記述を多く確認できた。その一例としては、一般にサゴートラ親族内婚を禁止すると理解されてきた法文が、同書においては特定の種類の息子への相続禁止として解釈されている事実を指摘できる。それと並行して、ロンドン、オックスフォードなどで写本・稀覯本調査を行った。この写本調査からは、未出版であるガウディーヤ学派作品群、相続法小論稿（例えば、「嫁姑間の遺産をめぐる論争」Svasrusnusadhanavivada）などの史資料を閲覧・入手することができた。また稀覯本としては、特に「カリ期(ヒンドゥー教的な最衰退期＝現代)における窮迫時のダルマの全て」Kalyapaddharmasarvasvaが注目に値する。同書には、現代では息子として嫡出子と養子のみが認められる(「12種類の息子たち」dvadasaputraなどとして知られる、伝統的な息子論議を排する)という論議を展開しており、本年度前半で行ってきた研究に新たな視点が追加された。また、アウトリーチ活動としては、南アジア地域における著名な大叙事詩『マハーバーラタ』における登場人物たちの相続法上の関係を考察し、一般講演を行った。
