本年度の成果については、主に二点ある。１つめは、コンコルダ期における政教関係に関する法制度の概要、趣旨の把握、および当時の学説の信教の自由や公認宗教体制に対する理解について整理をしたことである。同時期については、単に法律の規定の内容だけでなく、法や判例に対する分析や当時の法学説が前提としていた宗教理解までも検討している点で、これまでの研究にはない、付加価値を提供しているものと考えている。まだ日本で紹介、検討されていないものも多く。当時の法制度の理解の深化につながりうる成果と考える。２つめは、政教分離法制定の前後期における判例および学説の整理である。そのなかでも特に、政教分離法（１９０５年法）に対する学説の理解は様々であるところ、これらの見解はやはり日本では詳しく分析されたものはほとんどないと言って良い。同法をめぐっては単に政教分離という視点だけでなく、国家主権の問題や条約の一方的破棄の可能性など、国際法上の論点も存在するが、日本ではそもそもこうした論点が存在することすら知られていない。その意味で本研究は、こうした論点の存在に加え、各論者がそうした論点にどのような回答を与えてきたかについて、詳しく整理している。このように政教関係の紀律にとどまらず、国際法上の論点にも手を広げ、同法の問題を検討したことは新たな視角を提示した点で重要な意義を有すると考えられる。こうした点も含め、当時いかに多様な議論がなされたかを知ることはフランスの政教分離を理解する上で重要な意義をもつばかりでなく、２０世紀のフランス法の学説を知るうえでも重要な基盤を提供する。
