项目摘要

本研究課題2年目の2022年度は、1912年イスラーム法成立をめぐる外交的背景、特にハプスブルク帝国とオスマン帝国との外交関係の分析に重点を置いた。当初の研究計画から遅れてではあるが、令和3年度若手研究者海外挑戦プログラムを利用して、今年度前半にウィーンでの在外研究を実施できたため、オーストリア国家文書館・ウィーン市立文書館での未刊行史料の収集・分析、ならびにウィーン大学図書館・オーストリア国立図書館での二次文献の収集・分析を重点的に行った。収集した資史料からは、1912年イスラーム法制定の背景としてボスニア領有によって生じた課題への対処が重要であったこと、具体的には当時のハプスブルク帝国は、オスマン帝国との関係を重視しつつ、ボスニア域内のみならず、ボスニア域外においてもムスリム住民の法的地位や信仰の自由を独自に規定し彼らを帝国に取り込んでいくという課題に直面しており、まさにこれこそが1912年イスラーム法の成立背景であったことが解明された。以上の分析結果によって研究成果を論文としてまとめ上げることが可能となったため、今年度に査読誌『東欧史研究』に論文を投稿し、採択された。同論文は2023年4月に刊行された。さらに次に取り組むべき研究課題として、1912年イスラーム法の法案作成をめぐる関係各省間の会議に先立って作成された同法の草案A~Cの分析を進めている。この草案A~Cは先行研究では散逸したとされていたが、昨年度、会議に先立ち関係各省に送付された同草案の写しからその内容を独自に確認することができた。今年度では特に、草案の内容を同法の成立過程のなかに位置づける作業を進めてきている。その成果の一部はすでに2023年3月21日に開催された歴史論研究会関東部会にて発表することができた。現在までの研究成果をもとに2023年度内に論文としてまとめ、学術誌に投稿する予定である。
