Functional and theoretical reassessment of principle of equality in civil execution

我国现行民事执行法中的平等原则不宜废除。在优先权原则下，将更加强调破产法，以确保债权人的平等，能够监督债务人活动的强大债权人可以很容易地将弱势债权人从民事执行过程中淘汰。最重要的是，应赋予弱债权人以优先权，解决债权人之间的不平等，使所有债权人都有机会了解和参与民事执行过程。

The principle of equality in our current law of civil execution needs not to be abolished. Under the principle of priority, more emphasis will be put on the insolvency law to secure the equality of creditors, and strong creditors who are able to monitor debtors' activities can easily wash out weak creditors from the process of civil execution. Most importantly, week creditors should be grant priority to week so as to settle inequality among creditors, and all of the creditors should have opportunities to know and to participate in the process of civil execution.
