The Pension division system during divorce - In reference to Germany -

日本从2007年开始实行离婚时可以分割年金的年金分割制度。然而，该系统的使用情况比预期的要少。因此，本研究以作为日本制度基础的德国制度为研究对象，考察日本制度形成过程中较为突出的特点。德国的制度本身在2009年进行了修订。我们的研究结果表明，我们应该从社会保障法的角度来看待这一制度，并由此假设一个统一的、平等的养老金分配。此外，这种制度上的对应是必不可少的。

In Japan, a pension division system that allows pensions to be divided in the event of divorce was introduced in 2007. However, the system has experienced less use than expected.Therefore, this research focuses on the German system, which was used as the basis for the Japanese system, and investigates the features that were prominent for the creation of the Japanese system. The German system itself was revised in 2009.The results of our research concluded that we should approach the system from the perspective of social security law, and henceforth presume a uniform and equal division of pension.Furthermore, this institutional correspondence is essential.
