项目摘要

本研究は、地域社会史研究と法制史研究の接合が方法論の主軸であった。そのため、地域レベルの一次史料の発掘・収集と、法制史研究の成果を踏まえた立論の2点を、研究遂行の上での重要な課題として設定していた。前者（一次史料の発掘・収集）については、2022年度もまた、新型コロナウイルス感染症の感染拡大により、予定通りの史料調査を実施することが非常に困難であったものの、最低限、「義倉文書」、および「信岡家文書」の内、研究課題に関する重要史料を収集することはできた。後者（法制史研究の成果を踏まえた立論）については、法制史研究に関する先行研究や法理論に関する概説書を多く調達することができ、この点に研究費の多くを費やすことにもなった。そして、その通読からは、多くの示唆を得ることができた。研究課題の一方は本年度をもって完了させることができたと言える。具体的には、民法・商法が民間団体の在り方に与えた影響について、史料上だけでは読み取れにくかった「法理」の影響を、より明瞭に論じることが可能となった。その成果を踏まえた上で、日本史研究会の依頼により、2022年12月に「「陰徳」の会社経営と近代法―福山「義倉社」を中心に―」と題する研究報告を実施した。ここでの研究報告の実施と、討論により、新たな実証課題や研究史上の位置付けについて、認識を新たにすることができた。以上が、2022年度の研究成果に関する概要である。
