项目摘要

本研究の目的は、オーストラリアの行政決定司法審査法（ADJR法）の成立経緯、その内容等を見た上で、この法律が行政法機構の中で生じさせてきた諸問題を分析、検討することを通じて、行政法機構の中での法典化法の機能という視点から、行政法の法典化を検討するための基本的枠組みを構築し、それに基づき、現在までの日本の行政法の法典化の内容を評価するとともに、今後予想される法典化の進展において、いかなる問題が生じ、どのような対処が必要であるのかという問題を検討することである。前年度はオーストラリアのADJR法の研究に注力したが（本年度論文を公表している）、本年度は、オーストラリアから帰国し、またコロナの規制のためオーストラリアに関する研究を進めることが難しかったため、日本の一般法とそれが生じさせている諸問題について検討を進めた。行政手続法、行政代執行法、行政不服審査法、行政事件訴訟法、国家賠償法などは、その管轄する事項についてある程度の定めを置いた上で、対象について一般概括主義を採用し、行政活動について、原則として、根拠となる法律の区別なく適用されることが目指され、それを規律、統制し、政府責任の追及の実体的手続的根拠となってきたのであるが、様々な領域の多様な個別法による行政活動の過程を構成する諸種の行為に広く適用されるために、個別法の側の諸事情との調整がなされなくてはならず、諸種の問題を生じさせてきた。研究では、諸問題を検討する前提として、それらの一般法について、その性格、制定理由、一般法性の根拠、射程の諸点を整理した後、その規律状況、問題を摘示し、具体的な問題として、一般法の連結と規律範囲の問題に焦点をあてて検討を行った。
