项目摘要

本研究は、超少子高齢社会を背景とする中で種々の問題点が指摘されることになったマンション管理制度（例：マンション居住者の高齢化に伴いマンション管理組合の役員の成り手がいない、輪番制にしても後期高齢者が相当数を占めるに至り、これまでと同様の活動が期待できなくなっている等）につき、法的視点から行う研究である。これまで当然視されてきた分譲マンションにおける管理方式である、区分所有者が自主的に行う自主管理方式には無理があり、区分所有者ではない第三者たるマンション管理業者にほぼ全面的に管理を委託する第三者管理が近時進行しており、第三者管理の課題と対応につき比較法的手法により研究するのが本研究である。具体的には、わが区分所有法の母法たるドイツ住居所有権法（WEG）におけるマンション管理の中核である管理者及び管理顧問会につき紹介・検討を行う（当然、２０２０年ＷＥＧ改正をふまえる）。ドイツ法においては、マンション管理の中核となる管理者には第三者たる管理業者が就任することはほぼ当然の前提になっており、マンション管理については第三者管理を前提としたうえで制度設計がなされている。この点、第三者管理が進行しつつある我が国にとっては、比較法の対象としてドイツ法を紹介・検討する理論的・実務的意義がある。２０２２年度にあっては、マンション管理におけるより根本的な内容を紹介・検討することとした。即ち、第三者管理を前提とした場合における管理者の職務・権限についてどのように考えられているのかについて紹介・検討を行った。かかる研究の研究成果として論文を公にした（駒澤法曹１９号、２０２３年３月）。
