项目摘要

研究代表者・分担者による研究会を実施し、認知症者の人権と家族の利益、公益との利益衡量の問題を中心に、医学的見地、法的観点、哲学的視点から議論を重ねた。（第１回：2022年8月28日、老成学研究所（静岡県浜松市内）、第２回：2023年3月11日～12日、安田女子大学（広島市内））家族に要介護者のケアが事実上強制されるような状況を生じさせる法律上の責任は、刑法上の責任（保護責任者遺棄罪、刑法218条、等）と民事上の責任（不法行為、民法709条以下、扶養義務、同法877条以下、等）に大別される。そして、刑事責任が問題となる場合は通常は民法上の不法行為の要件も充足する。さらに、民事上の責任は金銭的な責任（賠償責任）が無限定に拡大しうる場合（不法行為責任など）と限定的なものに留まる場合（扶養義務等）に大別することができる。従って、「家族に要介護者のケアが強制されるのはどのような場合か？」という問題の焦点は、「民事上の責任は金銭的な責任（賠償責任）が無限定に拡大しうる場合（不法行為責任など）」に絞ることができる。以上を踏まえ、現行法の解釈によって認知症者の自由を拡大し、要介護者の家族の負担を軽減できる可能性について検討した。その成果は以下のとおりである：不法行為責任の成立範囲を拡大することによって認知症者の自由を拡大する方法としては、「衡平責任」の原理の導入等によって責任無能力者自身が不法行為責任を負う場合を設けるという方向性が考えられる。その反面、不法行為責任の成立範囲を限定することによって認知症者の自由を拡大する方法としては、「監督義務者責任」に基づく帰責範囲の限定によって、第三被害者の受忍すべき範囲を広く認めるという方向性が考えられる。
