项目摘要

本研究の3年次にあたる2022年度には、「家族法の変化と運用」について、おもに3つの点で研究を進めた。(1) 2021年2月にエジプトで生じた身分法制定問題を取り上げた（身分法は現地での家族法の呼称）。政府によって準備され、議会に提出された法案の原文を入手し、新聞記事等から制定に向けた動きと背景にある政治的状況、法案に対する批判、そして結果的に成立しなかった理由を探るとともに、法案内容を翻訳した。この作業を2021年度末から進め、2022年5月と8月に『高千穂論叢』に法案解説と全文翻訳が掲載された。(2) 2022年5月にはエジプトで再び身分法制定の動きが生じた。政府（司法省）に準備委員会が設置され、2021年2月の法案とは異なる、別の法案が作成されはじめた。2022年12月末には中間報告が出され、近いうちに議会に提出される見込みであると報道された（ただし、2023年3月末時点でまだ提出されていない）。この動きの経緯とこれに外部から関わるアズハルの対応について論文にまとめ、2023年5月に刊行される予定である。(3) 2022年7～8月に、新型コロナウイルス感染症（以下、コロナ）に関わる渡航制限が緩和されたため、エジプトに渡航し、「家族法の運用」に関係する司法関係者や家族間の訴え、行政・司法文書の調査を初めて行うことができた。エジプトでは2004年に家族問題に特化した「家族裁判所」が設置されているが、この裁判所において／に関わるどのような調査が可能かを探った。私的な問題を扱う家族裁判所へのアクセスは困難であり、そうした問題を抱える当事者から裁判や調停の進め方を聞く方法をとる方が現実的であることがわかった。そうした聞き取りから得た資料をまとめて2022年12月に英文での論文投稿をした。
