项目摘要

本研究は、現代エジプトのイスラーム的寄進制度「ワクフ」（個人が私有財産の所有権の移転を「停止waqf」し、その財産から生じる使用利益を指定した受益者に与える制度）を、法制度と具体的な実践の両面から明らかにすることを目指した人類学的研究である。研究第2年度である2018年度には、第1年度に進めた現代エジプトのワクフに関する資料の収集と制度の全体状況の整理を踏まえ、20世紀以降の法制史的展開を通じたワクフ制度の変容と、特にその中における「司法」の役割について、資料の分析と原稿の執筆を進めた。すでに第1年度には、ワクフ制定法（1946年法律第48号や1952年法律第180号など）、これらに関する司法判断（1952年法律第180号の第3条の2008年違憲判決）、ワクフ関連条項を含む2010年代の新憲法などの資料を収集・分析した。第2年度には、研究計画で予定していた通り、1946年法律第48号制定当時の議論を広範に記録している議会議事録や、ワクフに対する社会的関心を示す新聞記事（1950年代から2010年代まで）を資料に加え、20世紀後半のワクフ制度の変容状況の検討と執筆作業を進めた。第2年度には、2018年8月と2018年12月に二度エジプトに訪問した。特に、司法への関心にもとづき、2018年12月には、エジプト民法典の邦訳を行っている弁護士有志による「エジプト・アラブ共和国における法制度に関する調査研究」派遣団に参加し、裁判所や検察庁、登記局、大学法学部等を訪れ、司法制度と実務の状況を観察し、司法実務者との対談、裁判傍聴等の貴重な情報収集の機会を得た。司法における調査・研究の可能性を感じた。2019年4月から就職のためJSPS特別研究員を中途辞退することとなり、最終年度の計画は実施できなくなったが、今後も発展的に継続させていきたいと考えている。

This study aims at the anthropological study of the specific implementation of the modern system of private property transfer, use of benefits and designation of beneficiaries. In the second year of the study, in 2018, we will continue to review the collection of data and the overall status of the system in the modern Internet of Things, and the development of the history of the legal system since the 20th century. We will continue to review the changes in the Internet of Things system, the "judicial" aspects of the special administration, the analysis of data, and the writing of manuscripts. In the first year of this year, we collected and analyzed the data on the enactment of laws (Law No. 48 of 1946 and Law No. 180 of 1952), judicial judgments (Article 3 of Law No. 180 of 1952 and Unconstitutionality Judgment of 2008), and related articles including the new constitution of 2010. In the second year, the research plan was established, the discussion at the time of the enactment of Law No. 48 of 1946 was recorded, the parliamentary proceedings were recorded, and the social concerns were displayed. The news records (from the 1950s to the 2010s) were added. The discussion of the state of the social system in the second half of the 20th century was carried out. 2nd Annual Meeting, August 2018, December 2018 In December 2018, the Ministry of Justice sent a team to participate in the investigation of the legal system of the People's Republic of China, the Ministry of Justice, the Ministry of Registration, the Ministry of Law of the University, etc., to investigate the state of the judicial system and the administration of justice, and to discuss with judicial officials. The opportunity to collect valuable information such as referees was obtained. The possibility of judicial investigation and research is felt. April 2019: JSPS Special Fellows are dismissed halfway through their inauguration, and the final year's plan is implemented and developed.
