本研究は、いわゆるGAFAなどによるデジタル・プラットフォーム上の購買環境が発展した現状を踏まえ、商標法理論の原理的な再構築を目指すものである。19世紀に現れた近代商標制度の根幹は商標の「出所表示機能」であるが、デジタル・プラットフォームの登場した今日では、まったく不十分である。特に、Ａ.商品のトレーサビリティの確保、Ｂ.ネット販売におけるブランドイメージ、さらに、Ｃ.ネット販売における「事業者」の意義について抜本的に見直すことが目前の課題である。これらを踏まえ、「品質保証機能」こそが商標の基本機能だとする方向で商標法理論全体を組み直すのが、本研究の眼目である。令和4年度は、当初計画にもとづき、特にＡに関し、文献調査のほか、本研究の焦点となる輸入洋酒につき5度にわたり対面・リモートによる調査を行い、関係事業者や所管の国税庁酒税課との間で有益な意見交換を行ったほか、工業製品と対比するため、日本を代表するメーカーを訪問して対面調査を行った。またＢ・Ｃに関する商標法の改正が実現したことに伴い、理論構築を試みた。もっとも、内外での対面調査、特に海外における調査は、コロナ禍のため不十分であった。これと成果の取りまとめが、令和5年度の課題となる。
