项目摘要

本研究の目的は、最も基本的な国際条約であるベルヌ条約における著作物概念についての国際的な理解を確定しようとするところにあり、それは、わが国の著作権法の解釈のみならず、今後なされるべき立法を構想するにも、国際的な理解を踏まえておくことが必要だとの問題意識に基づくものであった。ところが、本研究の申請を行ってから、ガット・ウルグアイ・ラウンドの交渉が予想外に急激に進捗し、1994(平成6)年の末に最終的な合意を見るに至った。そして、そこで成立したマラケシュ協定には、貿易関連知的財産権協定なる文書が付属しており(付属書-C)、世界貿易機関(WTO)のすべての加盟国に知的財産保護の最も基本的な枠組みを提供するに至った。そのため、本研究の課題を達成するためにも、当該協定の研究が必要不可欠となった。貿易関連知的財産権協定は「ベルヌ・プラス」方式を採ると言われるように、ベルヌ条約の内容を大幅に取り込んでいる。しかし、その成立にアメリカ合衆国が深く関与しているだけに、従来欧州諸国主導で作り上げられてきた同条約への国際的な理解まで引き継ぐかどうかは、定かでない。そこで、本研究の課題を遂行するには、貿易関連知的財産権協定とベルヌ条約の相互関係を確定することが必要かつ有益であると考えられる。そのため、本年度の前半は、同協定についての調査に注力することとし、発足間もない協定であるため調査にかなりの難儀をしたものの、幸い、別添のような研究業績を挙げることができた。その後は、それを踏まえ、欧州諸国、とりわけドイツにおける著作物概念の伝統的な理解を研究しており、近い将来論文等の形で公表する予定である。

The purpose of this study is to determine the international understanding of the most basic international treaties, the concept of international treaties, the interpretation of international laws and the assumption of future legislation, the international understanding of international treaties, and the awareness of necessary issues. The application of this study was carried out in the early 1990s, and the final agreement was reached at the end of 1994. The Agreement on Trade-Related Aspects of Property (Agreement on Trade-Related Aspects of Property) provides the most basic framework for the protection of property known to member countries of the WTO. This study is necessary when the agreement is reached. The trade-related property agreement is based on the "" approach, and the content of the treaty is substantially different. The establishment of the United States of America is a matter of deep concern and deep concern. The European countries are leading the way in international understanding of the treaty. This study aims to determine the relationship between trade-related property agreements and treaties. In the first half of the year, the company paid attention to the investigation, and the company paid attention to the investigation.
