项目摘要

情報技術(IT)の発達により、デジタル著作物の複製・共有行為が既存の著作物流通産業に影響を与えており、デジタル著作物の管理・流通においては技術の進展に即した社会制度設計が早急に求められている。本研究では、権利処理の実務動向やファイル交換ソフトを巡る日米の訴訟など実際の問題を踏まえ、デジタル著作権の管理・著作物の流通に関する新しい法整備のありかたを論じることを目的とした。著作権・著作隣接権を保護するための技術的手段、権利を円滑に処理するためのシステム、手段・システムを支えるための著作権法制それぞれについて調査を行い、成果として、以下のことを明らかにした。技術的なコントロールの試みは、その迂回技術との絶え間ない競争であって、ある技術のセットが本質的に有効な手段とはなりえない。このため法的規制と社会のシステム双方に依拠し、経済的効率性と規制のバランスをとった杜会構造の構築が必要である。権利処理のシステムの一環としては、法改訂に伴う規制緩和により著作権の仲介業務に競争原理の導入が見受けられるが、既得権者に対抗する新興勢力の連衡がシステム変革に追い風となっている。訴訟問題においては、従来の判例にのっとった法的解釈が急速に発展する技術に対応しきれず、判決と現実の問題との不整合を指摘しうる。米国においては、ネット上の知的所有権の強化が推進されているが、規制強化がいかなる影響をもたらすか注目される。音楽ファイル交換サービスは、著作権等の処理さえクリアできれば、音楽配信事業の有望なビジネスモデルとなる可能性を有する。米国のレシグ教授等が提案する強制許諾の仕組みのように、P2P技術の長所を生かしながら音楽著作物の公正な利用を実現できるような解決がなされることが期待される。今後は映像ソフトをも含めたデジタルコンテンツ流通をめぐる著作権問題を俎上に載せる必要があろう。
