项目摘要

特別研究員（DC1）採用最終年度となる本年度は、前年度に打ち立てた武力行使禁止原則の二元的理解（武力行使禁止原則を国家対国家的視座と人間的視座の両者から捉える理解）に基づき、同意に基づく武力行使の実践的問題、すなわち、領域国の同意によって当該領域国内での他国による武力行使が正当化されるのはいかなる場合かという問題に取り組んだ。そのような実践的問題として、以下の３つの問題に分け、各論的に実証研究を行った。第1に、同意に基づく武力行使の実体的要件である。武力行使禁止原則の二元的理解に基けば、同原則の保護法益は抽象的国家利益と一定の人間的利益である。ゆえに領域国政府からの同意が、抽象的国家利益のみの放棄であり一定の人間的利益の侵害を意図したものではないことを客観的に判断することが必要となる。第2に、同意に基づく武力行使の手続的要件である。同意を与える主体、同意の態様、同意を与える時期につき、武力行使を正当化する同意が有効であるためにいかなる要件が課されるかが問題となる。第3に、自衛権の議論における同意に基づく武力行使の位置付けである。同意に基づく武力行使と集団的自衛権の関係、非国家主体の武力行為の国家への帰属をめぐる議論との関係、非国家主体に対する自衛権をめぐる議論との関係、がそれぞれ問題となる。以上の3つ論点につき、国家実行の分析を通して検討しつつ、武力行使禁止原則の二元的理解がどの程度国家実行に支えられているかを示した。結果、武力行使禁止原則の二元的理解は、同意に基づく武力行使の理論的問題を解決できるだけでなく、実践的にも国際社会の現実を捉えるに有用であると結論づけられた。研究結果は国内の研究会で発表するとともに、博士論文「同意に基づく武力行使の理論と実践―武力行使禁止原則への人間的視座の導入―」としてまとめ、博士号（法学）を取得することができた。
