项目摘要

まず、２０２１年度に引き続いて、フランスで展開されている「人の法」の基礎や本質をめぐる議論を研究し、特に、法的な場面に登場する「人」について、どのような事案に着目し、どのような側面をとりあげ、どのような視点から捉えているのか、また、その成果をどのような形で法的な体系＝「人の法」として構築しているのかといった点に注目して検討を行った。この研究によって、個別の制度や事例等をそれ自体で検討するだけでは不十分であることが再確認されるとともに、「人」の捉え方の複合性に着目し、それぞれの観点の相互関連性を意識しつつ、包括的な視点から「人の法」を構想していくための基礎が形成された。また、２０２２年度も、前年度までに引き続いて、民事責任法以外の民事法および公法や刑事法、更に、諸学問分野における「人」がどのように捉えられているかを明らかにする研究に引き続き取り組んだ。本年度は、特に、（法）哲学、（法）社会学、行動科学等における「人」の多様な捉え方を解明するための研究を実施した。更に、現代的な個別問題との関連で「人」の捉え方や「人の法」がどのような意義を持つかについて考えるために、現代的な個別問題を分析する作業を行った。２０２２年度は、特に、①LGBTQ等が提起する問題との関連におけるあるべき法的な「人」の捉え方、②SDGsに関わる様々な問題との関連におけるあるべき法的な「人」の捉え方、③AIとの対比、または、AIが浸透した社会におけるあるべき法的な「人」の捉え方、④複合的な被害をもたらした福島原発事故が提起する問題との関連におけるあるべき法的な「人」の捉え方、⑤生殖補助医療の普及と発展との関連におけるあるべき法的な「人」の捉え方について、裁判例や議論の状況の分析、前年度までに得られた「人」を法的に捉える際の複合的な視点、比較法的な分析等を踏まえて、検討を行った。
