项目摘要

2022年度は、国際的な刑事裁判所における刑事司法機能の意義について引き続き検討を行った。2022年2月に生じたロシアによるウクライナ侵攻を受けて、国際刑事裁判所（ICC)の検察官による取り組みについて事実関係を確認した。検察による、ウクライナおよび関係国における証拠の収集、それをより迅速に進めるための関係国および関連国際機構との連携の構築などは、今後の国際的な刑事裁判の実施に向けた取組みとなっている。ICCは、その訴追と処罰の機能が、平和とガバナンスに資するものであるとの立場である。そこで、ウクライナへの侵略に伴う刑事司法機関の取り組みについて、平和構築機能と捉える可能性についての検討が必要になる。今年度の予備的な検討からは、以下の点が確認された。まずウクライナ領域内で生じた国際人道法違反の調査は、将来の訴追に備える作業である。この取り組みは、侵略から生じる国際犯罪について、不処罰を阻止するものであり、この理解が国際社会に共有されまた実施されようとしていることが評価される。その一方で、ウクライナの状況を重点化するICCの方策は、他の地域における事態の捜査に否定的な影響を及ぼしうるものである。さらに、ICCによる訴追と処罰と、ICCの補完性の原則との関係性が今後は具体的な課題となるだろう。ウクライナの状況はくわえて、多数の被害者に対する賠償などを、はたしてまた誰がどのように行うのか、という問題をも提示する。
