本年度は、国連による「統治」の事例として、ボスニア・ヘルツェゴビナ共和国における上級代表事務所(OHR)の機能および役割について調査、研究を進めた。国際法学会、国際機構論研究会への参加を通じて、国際機構および条約によって設立された国際的な組織が現地において果たす役割、またその活動が.国際社会に与える影響についても理解を深めた。9月にはオーストリアおよびボスニア・ヘルツェゴビナにおいて調査を行い、OHRおよび関連地域の訪問、国際機関に勤務する専門家とのインタビューおよび意見交換を行った。本年度の研究によって明らかにされた主要な事項は以下の点である。(1)ボスニア・ヘルツェゴビナにおいて、上級代表事務所(OHR)は、同国の行政、立法、司法全てに関して権限を有しており、実質的に独立国を統治している。またその権限は、統治機構や制度を設立し改革することに加えて、それらが実効的な役割を行なうことをも含む。(2)上級代表事務所(OHR)によって体現される国際社会による統治は、国際社会によって確認されている規範としての民主制、法の支配、人権と基本的自由が、現地社会に定着することをもその活動の目標とする。とくに民族間の対立を背景とする社会では、これら規範が政治的に用いられ、民族間の分断を正当化し固定化することがないように、国際社会による監督や助言などの関与が引き続き求められるが、これは国家主権、民族自決との対立をもたらす。(3)ボスニア・ヘルツェゴビナにとって、これら規範の実施は、欧州連合への加盟に向けた前提条件となっている。以上のとおり、独立国においても国際社会によって統治が行われているボスニア・ヘルツェゴビナの事例は、国際社会における規範の確立、国際的な組織の権限の拡大と深化およびその問題点をも明らかとするものであった。また同時に、国際社会の活動と国家主権の対立をも浮き彫りとするものである。
