项目摘要

本研究では、「明治期の監獄が、近世から連続しているのか、断絶しているのか――すなわち、明治日本は「西洋」「近代」的な監獄を獲得できたのか」という問いに対して、一定の回答を得ることを目的としているが、かかる目的を意識しながら、本年度は「自由刑の場としての「監獄」」『歴史評論』876号（2023年4月、19-29頁）を発表した。同誌に掲載された、拙稿を含む特集「「監獄」研究の現在」では、分野の異なる複数の研究者がさまざまな観点から明治期の「監獄」を論じており、本研究が目標とする「明治日本が「西洋」「近代」的な監獄を獲得できたか」という論点への、各領域からの応答となっている。拙稿は、従来の研究をまとめる形で、「監獄」で行われた自由刑がいかなる理念のもと、どのような形で執行されていたかを、“刑罰の不可視化”という観点から論じた。その中で、明治日本に（近代的な）「監獄」が成立したと評価できるのは、1890年代であると結論づけた。なお、本研究のテーマと直接的に結びつくものではないが、本年度に刊行された「1940年代後半の監獄法改正作業にみる戦前戦後の接続―立法資料から読み解く「中間的処遇」と「代用監獄」―」（石塚伸一編著『刑事司法記録の保存と閲覧』（日本評論社、2023年2月）235-258頁）には、本研究費を利用して行った史料収集の成果にもとづく記述がある。同論文は、日本の行刑において大正期から意識された「中間的処遇」が、終戦直後の監獄法改正作業においてどのように論じられたかを確認したものであるが、その前史にあたる明治・大正期の「中間的処遇」・「構外作業」への理解は、前掲『歴史評論』誌所載論文の執筆に際して行った調査とその成果にもとづいている。
