2022年度は、近時、英語圏の自由意思論・刑罰正当化論において存在感を増しつつある「自由意思懐疑論（Free Will Skepticism）」について、その現代における代表的な支持者であるGregg D CarusoおよびDerk Pereboomの著作を中心に、関連文献を収集・読解した。その中でも、刑法への応用を視野に入れて活発な執筆活動を展開しているのはCarusoであり、その主著であるRejecting Retributivism (CUP, 2021)の分析に時間を割いた。その結果として、自由意思懐疑論は、①刑罰制度の単なる廃棄を主張するものではなく、むしろ、自由意思（他行為可能性）や応報といった観念から解放された、合理的な刑罰制度の構築のための建設的な指針を示すものであること、②刑罰正当化論においてわが国でも近時有力な応報刑論に対して、わが国では必ずしも認識されていない複数の問題点を提起するものであること、などが明らかとなった。なお、文献の読解作業と並行して、英語圏の自由意思・道徳的責任論に関する基礎的文献であるMatthew Talbert, 'Moral Responsibility' (Stanford Encyclopedia of Philosophy, Fall 2022)および、上記「主著」の要約といえる論文であるGregg D Caruso, 'Retributivism, Free Will, and the Public Health-Quarantine Model' in M C Altman (ed), The Palgrave Handbook on the Philosophy of Punishment (Palgrave Macmillan, 2023)の翻訳作業を進め、完了した。いずれも23年度中に公表される予定である。
