本研究は、環境行政意思決定のアカウンタビリティを確保するための法的枠組の発展に対して、議会オンブズマンおよび環境オンブズマン（O/EO）を中心とする公的オンブズマンが果たす役割の本質を明らかにすることを目標としている。本研究の対象となる行政府のアカウンタビリティの射程は、行政府の執行部門の活動の正当性や妥当性である。O/EOを中心とする公的オンブズマンは、このような行政府のアカウンタビリティを確保するための審査機関としては、20世紀後半に世界的な普及が始まった比較的新しい機関である。伝統的な審査機関である裁判所や審判所と公的オンブズマンの違いは、前者が個別の事件解決を通じて目的達成を図るのに対して、後者は構造的問題の解決を通じて目的達成を図る点にある。本研究は、このような公的オンブズマンの特性が、アカウンタビリティ確保の仕組全体に与える影響の解明を志す。本研究課題の達成には、環境行政意思決定のアカウンタビリティ確保に際して、公的オンブズマンの特性がどのように発揮されるかに関する調査分析が必須となる。この分野に関する研究の蓄積は余り豊富ではないため、文献調査のみに依存することはできず、公的オンブズマンを有する法域に於ける現地調査を多く行うことを予定していた。しかし、コロナ禍の影響により、海外調査が行えない期間が3年間続いたので、極力海外調査に頼らずに公的オンブズマンの特性を明らかにすることに注力し、事例分析を通じての環境分野に於ける行政意思決定のアカウンタビリティ確保に公的オンブズマンが果たし得る役割の検証や、行政府による苦情処理制度と公的オンブズマンの役割の差異の解明などに取り組んできた。令和4年度は、同年中のコロナ禍の悪影響の収束を見据えて、本研究の完遂に不可欠な海外調査の実施を計画したが、時期尚早であり、調査の実施は令和5年度に持ち越された。
