项目摘要

本研究は当事者が法システムにアクセスする際に生じる多くの障壁について実証的に明らかにすることを目的としている。とりわけ、当事者が法システムを実際に活用する際の心理的側面に着目し、法システムから排除されやすい状況にあると思われる人々が法システムにアクセスする際に直面する困難性とその克服方法について、フィールドワークを通して実証的に解明することを目指すものである。本年度は、昨年度に引き続き、法システムを活用する当事者自身が法的存在（法的機関、法専門職）をどのように認識しているのかに焦点をあて聴き取りを行った。その結果、これまでの聴き取り調査から得られた共通点（専門職達の持つ権威性に対する拒否感、躊躇、近寄りにくさ）が同様に語られた一方、法的存在への信頼感には差異が見られた。法的存在への信頼感の背景に何があるのか、それがどのように醸成されるのか/されないのかについては、サンプル数が非常に限られているため、現時点では十分に解明できていない。今後は、対象者の幅を拡げ、多様な背景を持つ社会的排除状態にある人々の実態に着目して聴き取りを行うことを通して、法的存在に対する信頼感の発生背景を探究していく。なお、この間対面での聴き取り調査が制限される状況がしばらく続いていたが、徐々に状況が許すようにはなってきているため、今後は引き続きオンラインでの聴き取りも並行しつつ、出来る限り対面での調査を実施し研究課題の遂行に努めたい。
