项目摘要

本研究の目的は、18世紀スコットランドの哲学者アダム・スミスが『道徳感情論』と『法学講義』で展開した法学原理の構造と意義を、そのテクストと法学的文脈（コンテクスト）の双方を踏まえて総合的に解明することである。令和元（2019）年度の研究内容は下記の3点に要約される。[1]平成29（2017）年度から継続していたスミスの刑罰論の研究をもとに、論文「アダム・スミスの刑罰論：理論史的探究」を公表した。[2]平成30（2018）年度に引き続き、スミスの所有権論を分析した。具体的には、①近代所有権論史において対立し、かつスミスに深い影響を与えた2つの学説（ロックの労働所有権論とグロティウスらの合意所有権論）の系譜上に彼を位置づけることで、スミスの所有権論の法理論史（法思想史）上の特性を検討し、②カントや森村進の所有権論と比較することで、その法哲学上の特性を検討した（特に①においては、イングランド法・スコットランド法・ローマ法の所有権に関連する制度・学説を参照した）。検討の成果は、ジョン・ロック研究会報告、東京法哲学研究会報告及び論文「アダム・スミスの所有権論：分析と再構成」において公表された。[3]スミスの司法論に着目して、平成29年度から令和元年度までの研究の総括を進めた。その成果は、一橋大学大学院法学研究科法文化構造論特殊研究報告において発表された。この報告では、現在までのスミスの司法論に関する通説的見解を整理し、それが個々の論点においてもはや維持するのが困難である一方、通説に代わる見解が今日なお提出されていないことを指摘した上で、この問題の解決（新たな司法論像の構築）のために用意される研究方法と議論の構成を説明した。
