親密な関係者間で生じた暴力のあったことが明記された判決文の中で、加害者に対して精神鑑定等を実施したことが明記されている判決文を選別した。判決文の調査は配偶者からの暴力の防止及び被害者の保護等に関する法律の施行から2022年３月31日までに判決文が出たものとし、刑事・民事の両方の事件を調査した。判決文の選定作業では、精神鑑定等を実施した事件数が少ないことが予想されたため、親密な関係者間での暴力の頻度や程度を限定せず、公判で争点となった事件以外にも暴力が生じていたことが確認された事例全てを調査対象に含めることとした。その中から精神鑑定の内容がわかる資料の閲覧が許可された事例についてのみ、裁判所で閲覧して必要な情報を収集した。
