本研究は、現代の国際社会において国際組織が果たしている国際紛争の平和的解決機能の諸相を、多面的視座から実証的に検討し、これを国際法体系全体の中に理論的に位置づけて体系化することを目的とするものである。そのための具体的な研究として、まず第一に現代の国際社会において最も重要な役割を果たしている国連の紛争解決機能に関しては、平成10年度及び平成11年度のそれぞれにおいて秋の国連総会開会中にニューヨークの国連本部へ各1週間ほどの実地研究に赴き、法律問題を所掌する国連総会第六委員会における審議の実情を調査し、多くの点を肌に感じて学ぶことができた。また、貿易・経済紛争の処理機関として1995年の発足以来その重要性を増しつつある世界貿易機関(WTO)の紛争処理機能についても、その前身であるGATTの紛争処理機能と対比しつつ検討を行い、その研究成果を平成12年3月にポーランドのルブリン大学にて発表した。これらの研究成果を理論化して中間的に発表したものが、研究論文「『国際組織法』の体系に関する一考察(四)(五・完)--『国際組織法総論』構築への予備的考察」『法学』62巻3号(1998年)・63巻2号(1999年)である。また、本研究の別の角度からの研究成果として、国際組織の「アカウンタビリティー」という観点からの研究をまとめ、本年中に論文として発表する予定(『法学』64巻3号)であり、さらに本研究の成果の一部は、間もなく刊行される予定の国際法学会百周年記念出版『日本と国際法の百年』(三省堂)の第9巻『紛争と裁判』に所収の論文「国連の政治的機関による紛争解決」としても公表の予定である。

The paper included in the 9th volume of "Dispute and Judgment" is "Dispute Resolution as a Political Organ of the National Federation" and "Predetermined Resolution of Disputes".
