Case Law and Legislation of Product Liability in Japan

本研究有两个目的。一是对日本产品责任判例法的实质进行了描述，二是对日本新产品责任立法进行了评述。今年，我打算公开我对上述两个问题的研究结果。关于第一个问题，我已经完成了对日本产品责任判例法的重述，并将副本与本报告一起提交。关于第二个问题，笔者在《新商法》第519期至第532期（共13次）发表了《一个立法上的比例：产品责任法》一文，并作了详细的评述。这部法律包括赔偿法、特别民事诉讼规则、行政救济制度和特别保险规则。通过与世界各国产品责任法的比较，笔者认为这部法律具有独特性和先进性。

This study has two objects. One is to describe the essence of the Japanese case law of product liability and the other is to make a proporsal of the new legislation of product liability. This year, I intended to make the result of my reserch public concerning the above two.With regard to the first object, I have accomplished the restatement of the Japanese product liability case law, and submit the copy with this report. This restatement will be published in a form of a monography this coming summer.Regard with the second object, I made "A Legisralative Proporsal : Product Liability Act" public with detailed comments in the New Business Law Journal from 519 issue to 532 (13 times). This proporsal contains compensation Law, special civil procedure rules, an administrative relief scheme and special insurance rules. Comparing with product liability laws in many countries, I, by myself, believe that this proporsal is very unique and advanced.
