项目摘要

本研究は、中国の地域自治組織である居民委員会及び村民委員会の法人化が両委員会の自治の保障に対していかなる意義を有するかを探求するものである。中国では、法人はもっぱら民事法の概念とされ、行政法や公法上の法関係では法人が観念されない。そうした中、本研究では、中国における行政活動の責任主体の議論が法人概念の影響を受けているとみられることに着目し、法人の行政法的意義を検討する。2022年度は、中国で法人がもっぱら民事法の概念とされている理論的背景を明らかにするため、1986年の民法通則制定時の議論やそれ以前の学説状況、ソ連社会主義法学からの影響などを文献資料に基づいて検討した。しかし、いずれの資料からも決定的な論拠は見い出すことはできず、現時点では未だ理論的背景を明らかにすることはできていない。もっとも、資料の中にはドイツや日本における国家法人説について検討した上で中国法の独自性について述べるものが見られ、中国で法人がもっぱら民事法の概念とされているのは単なる偶然ではなく、積極的な選択に基づいたものであるという手がかりは得ることができた。これを受け、2023年度は、中国の行政法学ないし公法学における国家法人説の受容と拒絶に着目して、引き続き検討を行っていきたいと考えている。また、近年、中国の行政法学では、行政基本法の制定や行政法の法典化をめぐる議論が活発化している。このような動きは、中国における行政法ないし公法の民事法に対する特殊性を表面化させるものでもあるため、本研究の検討に値する。そこで、本研究では、日本では批判の対象とされてきた公法私法二元論について、中国ではむしろ公法私法の間の線引きの必要性が強調されている点に着目して、その歴史的・理論的背景の考察を行った。
