Study on the change of the Structure of the French Constitution under the conditions of the European integration

本研究旨在从比较的角度对欧洲一体化条件下的近代法国宪法进行全面研究。我们在此关注(i)在联邦与主权关系框架内的欧盟内部结构，（ii）欧洲一体化与法国宪法修正案之间的关系，（iii）欧洲一体化条件下决策与“主权国家”之间的关系，（iv）欧洲共同体条约与法国宪法委员会（Conseil Constitutionnel）在法国宪法第54条的情况下，（五）比较法国式与德国式对欧共体法律至上与成员国宪法关系的看法；（六）法国与欧盟的安全；（七）国际对法国地方自治机构宪法学研究的影响；（八）d.s hnapper认为的“国家”与“城市”；（九）法国宪法学研究中人权理论从“自由公共性”到“基本权利”的转变；(x)若斯潘政府对外国人的法律制度；（xi）法国的两性平等，特别是为“党派”辩护的理论；（xii）欧洲一体化条件下的语言政策，特别是《欧洲地区或少数民族语言宪章》的批准问题；（xiii）多重“世俗”与《欧洲人权公约》的关系；（xiv）法国宪法中通讯自由的地位。（xv）《法国宪法》对社会权利的保障；（xvi）欧洲联盟和法国的社会保障；（xvii）欧洲联盟的规定和人权。我们的研究揭示了全球化条件下的优选宪法和宪政框架。

The purpose of this research is to study comprehensively the modern French Constitution under the conditions of the European integration from comparative points of view.We are concerned here with (i) the internal structure of the European Union within the framework of the relation between federation and sovereignty, (ii) the relation between the European integration and the amendments of the French Constitution, (iii) the relation between decision making and "souverainete nationale" under the conditions of the European integration, (iv) the EC-treaties and the Conseil Constitutionnel in the case of article 54 of the French Constitution, (v) a comparison French style with German style about the relation between supremacy of EC-law and Constitutions of member states, (vi) the security of France and the European Union, (vii) international influences to the French constitutional studies about local self-governing bodies, (viii) "nation" and "citoyennete" in the opinion of D.Schnapper, (ix) the change from "libere publique" to "droits fondamentaux" of the theory on human rights in the French constitutional studies, (x) the legal systems on foreigners under the Jospin government, (xi) the equality of the sexes in France, especially the theory to justify the "parite", (xii) the policy on language under the conditions of the European integration, especially the problem on ratification of the European Charter for Regional or Minority Languages, (xiii) the relation between multiple "laicite" and the European Convention on Human Rights, (xiv) the position of the freedom of communications in French Constitution, (xv) the guarantee of social rights in the French Constitution, (xvi) the European Union and the social security in France and (xvii) the regulation by the European Union and human rights. And our research revealed that the preferable Constitution and the framework of constitutionalism under the conditions of grobalization.
