研究成果は、研究計画に基づき大きく二つに分けることができる。(1)フランスにおけるHIV感染血液事件の被害者の救済は、初期には裁判を通じて実施された。それは、まず第一に、行政の輸血役務に対する規制権限の不作為を理由とした損害賠償請求である。フランスの行政裁判所系統の最高裁判所であるコンセイユデタは1993年4月9日これまでの規制権源の不作為に関する自らの判例を変更し、凝固因子製剤によりHIVに感染した血友病患者に対して、国の損害賠償責任を認める判決を下した。第二に、コンセイユデタは1995年5月24日、輸血用血液によるHIV感染者に対して無過失責任の適用を認める画期的な判決を下した。これは近時フランス行政判例に見られる、治療上の危険に対する被害者救済を拡大する動きと軌を一にするものであるが、それだけではなく、司法裁判所が蓄積していた輸血による感染被害者に関する判例との調和を考慮したものである。いずれにせよ、以上二つのコンセイユデタの判例は、従来の判例を変更し、あるいはより展開することにより、HIV感染被害者を救済した。(2)もう一つ立法による被害者救済についても触れておかなくてはならない。フランスでは1989年という比較的早い時期にHIVに感染した血友病患者を救済する特別な制度を創設したが、この制度が不十分であったことやまた上記の1993年判決の下級審判決が国の過失を明言したこともあり、1991年12月13日法による特別な救済制度を作り上げた。この制度は訴訟との関係など若干の問題を含んではいたが、血友病患者以外の輸血による被害者も救済の対象とするなど多くの点でわが国の制度を考える上での示唆を含んでいる。

The research results are based on the research plan.
