欧州諸国の外国人の地方参政権の実態調査を踏まえ、国民主権論、人権論、地方自治論に関する伝統理論と先端理論を渉猟しながら、日本国憲法の新たな可能性と限界を検討した。その際、日本国憲法11条および97条が「将来の国民」にも、基本的人権を保障していることに着目した。地方参政権にとどまらず、国政レベルの参政権をも要請する手がかりはここにある。ただし、欧米諸国のように、国民主権原理との関係から、二重国籍により、この問題の解決を模索する方法も可能である。そこで、法解釈論にとどまらず、具体的な立法政策上の諸問題を考察し、諸外国との比較のうちに、公職選挙法、地方自治法、国籍法の改正と入管実務の見直しについて、若干の提言を行っている。この成果をもとに、まず、外国人の参政権と国籍に関する一般書を公刊した。偶然にも、本書は、広く読まれたので、その第2刷では、最新の動向を踏まえ、若干の内容を刷新した。ついで、外国人の参政権問題を永住市民権(デニズンシップ)の観点から堀り下げた研究書を公刊した。本研究により、九州大学から学位をいただいた。そのエッセンスを論文にしてジュリストに寄稿している。また、英文のディスカッションペ-パ-を書き、欧米各国の大学、研究機関に送った。さらに、平成9年度の前期に公刊される翻訳本と、3つの学会報告により、本研究の成果を公表する予定である。いくつかの自治体、新聞社および読者からの研究内容に関する問い合わせには、できるだけ詳しく答えるように心がけている。本研究以外の研究成果として、5つの学術論文を発表し、以前から書いていたものと合わせ、近く政権交代と議院内閣制についての著書も公刊する予定である。なお、外国人の公務就任権の比較研究については、着手したばかりである。今後、外国人の居住権、社会権などにも、研究を広げていきたい。
