本研究は、国と自治体の多文化共生政策の異同をめぐり、日本と諸外国における法令、判例、学説を比較分析し、多文化共生社会を実現するための法制度の検討を目的とする。憲法と人権諸条約との整合的な解釈に配慮しながら、国と自治体の多文化共生法制の背後にある人権規範を考察する基礎研究をベースとする。国レベルの移民の権利保障を判定する移民統合政策指数のあり方を批判検討し、自治体レベルの移民・民族的少数者の文化的多様性を都市の活力等の源泉としているかを評価するインターカルチュラル・シティ指数や自治体の多文化共生推進計画の成果目標も批判検討したうえで、多文化共生社会における具体的な課題に応じた政策や法制度のあり方を考察する。2022年度は、市の関与、地域社会、公共空間、調停・紛争解決、ニューカマーの歓迎、国際協力、保健医療について、（国際および国内）人権規範に関する各国の学説・判例・法制度を比較分析する。とりわけ、調停・紛争解決と保健医療のあり方について、実効的な救済措置を受ける権利、健康への権利などの人権規範と諸外国の実務に照らし、検討した。とりわけ、自由権規約の実効的な救済措置と結びついた難民申請者の裁判を受ける権利と行政の適正手続に関する論文と裁判所への意見書が、新たな判例の形成に活かされ、東京高裁の確定判決では、はじめて憲法の人権規定の融合的保障が導かれた。愛知県・各務原市におけるインターカルチュラリズムを踏まえた多文化共生推進プランづくりにかぎらず、国の移民統合政策にみる日本の課題と展望に関する学会誌の論文の成果は、入管庁職員の研修講義にも取り入れられており、研究成果の実務への還元にも役立っている。
