项目摘要

本研究は、昭和六○年度から昭和六一年度の二年度にわたるものであるが、最終年度として本年度の研究実績は、比較法的研究,実態調査,およびその総括の三つの部分に分けられる。1.比較法的研究比較法的研究の主たる部分は、六十年度に終了しているので、本年度は、その補充として、二回の共同研究会を開催し、そのうちの一回は、日本と密接な経済関係を築きつつある中国における破産法制定の動向について外部の報告者から報告をうけ、研究をおこなった。また、二回目は、すでに破産法をもち、日本とも密接な経済関係をもつ台湾(中華民国)の破産事情について外部の報告者から報告をうけ、研究を行った。この研究によって以下のことが明らかになった。我国の企業の経済活動は、アジア地域においてもますます国際化の程度を深め、いったん企業倒産が発生したときの、処理が国際化するのは必至である。したがって、それに対処するための国内法の整備、および国際条約の検討が緊急に要請されていることである。2.実態調査本年度は、国際倒産法上の問題点を含む最近の著名な事件について、裁判官,管財人,申立代理人などの関係人に対するヒアリング調査を行った。たとえば、三光汽船などの倒産事件では、倒産企業が在外財産をもっているところから、それをいかに処理したかについて関係人から事情を聴取したのである。その結果、最近の大型倒産事件では、ほとんどの企業が在外財産をもち、管財人としては、法の不備からその処理に悩まされていることが明らかになった。3.総括以上の二つの分野にわたる二年間の研究を総括するものとして破産・会社更生法の関連条文の立法論的再検討、および国際破産条約の試案の検討を進めつつある。

This study is a comparative study of the results of this year's research, an empirical survey, and a comprehensive analysis of the three parts of the study. 1. The main part of the comparative method research is the end of the 60th year, the current year, the supplement, the second round of joint research meetings, the first round of close contact relations, the establishment of close contact relations, the development of bankruptcy law in China, the external reporter, the report, the research. The bankruptcy law of Taiwan (Republic of China) is closely related to the bankruptcy of Taiwan (Republic of China). The following is a summary of the results of this study. Our country's enterprise business activities, geographical areas, the degree of internationalization, enterprise production and development, processing and internationalization must be to the end. The preparation of domestic laws and the examination of international treaties are urgent. 2. Investigation of the current year's problems in international law, including recent well-known incidents, judges, financial regulators, legal agents, and related parties.たとえば、三光汽船などの倒产事件では、倒产企业が在外财产をもっているところから、それをいかに处理したかについて关系人から事情を聴取したのである。As a result, the recent large-scale bankruptcy incident occurred in the enterprise, and the management of the external property, financial personnel, and legal equipment was not handled. 3. Summarize the above two aspects of the division of research in the past two years, including the re-examination of the legislative theory of the related provisions of the bankruptcy and association law, and the review of the trial case of international bankruptcy treaties.
