今年度、本研究は、二つの方向から、二段階にわたって、消費者倒産について研究する計画であった。すなわち、第一段階として、比較法・比較制度的な研究として、(1)ドイツ・オーストリア、(2)アメリカ、(3)フランスの立法、法制度、法理論の研究を、各国の文献・判例の検証を通じて行うこと、第二段階として、わが国で破産宣告・免責を受けた消費者の経済的更生の可能性を、具体的事例をもとに検証する研究を行うことであった。上記計画に基づき、今年度の研究を以下のように実施した。まず、第一に、わが国における消費者倒産の実情及び問題点を少しでも明らかにするために、わが国で公表された文献(論文、資料等)並びに判例を可能な限り収集した。その際には、消費者倒産に対する実務界の動向に特に注意し、免責許可決定を与えるに際して、破産者が一定の債務について弁済することを条件とする実務が定着しつつあるという現状を知った。第二に、上記作業と併行して、ドイツ・オーストリア、アメリカ、フランスの資料の収集に当たった。ドイツ・オーストリア、アメリカの資料については、まず各国の単行本を入手し、次いで、その中で引用されている文献・判例を入手した。また、フランスの資料については、フランス法を専門とする研究者から最新の資料を入手するとともに、フランスの現状を聴取することができた。今現在は、手元に揃った、日欧の資料を読み分析している段階にある。研究計画の二段階には、時間の関係上入ることができなかった。なお、研究成果については、今年の10月を目途に公表する予定である。
