项目摘要

近代以後現代にいたる日本の司法制度は、陪審制度のつよいインパクトの下にあったことが改めて確認された。明治初期においては、すでに参坐制度の実施があった。これは、司法省の陪審法導入政策の一環であったことは明らかである。井上毅が陪審制度の導入につよく反対したことは、この参坐制度の経験によっている面もあると推測するが、残念ながら今の所確証を得ていない。ボアソナ-ドは陪審法の導入を、日本の司法制度の近代化と、条約改正に資するとの理由から推進した。これは井上毅の反対によって実らず、明治憲法下の裁判所構成法、刑事訴訟法も認めなかったが、明治30年代に入り、日本経済の発展と法体系の整備の下で、在野法曹の陪審制度の導入の動きが始まった。これが政友会の政治綱領の一つとなり、大正デモクラシ-の下で陪審法の成立に結実した。昭和初年の司法制度は、陪審法の実施によって、とくに捜査と立件の面においては影響された。もっとも、治安推持法などの陪審除外がその効果を減殺した。さらに戦時体制がその停止に追いこんだ。戦後の司法の民主化は陪審法の復活・改善を要求したが、司法部は参審の方向を推進し,しかしついにこれをも実現せず,裁判所法3条3項において、その将来の導入の可能性を認めたにすぎなかった。しかしその条項の存在は、その後の刑事訴訟法の改正や臨時司法制度調査会の審議において,つねに陪審問題を思い起させる役割を果した。とくに寃罪事件が明らかになると、日本の司法の民主制が、つねに国民の司法参加の観点から問題となり、最近では、各種の団体が陪審法草案の試案を発表するに至っている。このように、日本の司法制度における陪審制度のインパクトは、人々が一般に思っているよるも、ずっと深くつよいものがある。
