検察審査会は、戦後司法制度改革の一環として設置された。GHQ内部には、公判陪審制度、大陪審制度、裁判官・検察官の公選制度導入の動きも一部見られたが、現実化したのは最高裁判官の国民審査制度と検察審査会の制度であった。検査審査会制度の立法過程については、日本側の資料ではほとんど分らず、GHQ資料についても不明点が多い。但しGHQ担当官マイヤーズの論文により、GHQとしてはこの制度の教育的意義に重点をおいたことが明らかになっている。そのことは、検察審査会制度が、大陪審の逆の制度であって国民が訴追を決定するものでなく、検察官の不起訴処分を審査するものであること、しかも不起訴不当と起訴相当の議決に拘束力がないことによる。後者の点は、戦前の日本の陪審法の影響を認めてよいと考える。検察審査会に期待された教育機能は、おおむね充たされたと言ってよい。検察審査員OBは、この制度の意義を在任中に十分に認め、任期終了後自主的な協会を組織して広報活動にあたっている。この協会は、ほぼ検察審査会の所在地の大部分をカバーし、全国組織をもつに至っている。このような活動が、検査審査会の活性化を助けていることは疑いない。検査審査会事務局からの聞取りによれば、検察審査員達は、始めは就任にちゅうちょするが、任期終了時にはもっと続けてもよいというのが一般的なパターンであり、そのことが協会活動に接続している。また一般人のこの制度の周知度は、総理府の調査によれば、ほぼ20%を上まわる程度で推移している。もっとも昭和62年に東京検察審査協会が実施したアンケートによれば、周知度は38.3%となっており、都民の周知度は全国に比して格段に高いことが分かる。聞取調査の結果は、40年間大きな改正のなかったこの制度も、任期、候補者選定方法、議決の効力等再検討が必要であることを示している。
